Mesa Bankruptcy FAQ

How long does the Mesa Bankruptcy process take?

This mainly depends on the type of bankruptcy that you file. With Chapter 7 bankruptcy they can be completed as quickly as four month but normally take about six. The Chapter 13 process takes longer because as part of the process you have to pay off a portion of your debt. Chapter 13 bankruptcies normally take for 3 to 5 years.

How will Mesa bankruptcy affect my credit?

Your bankruptcy will remain on your credit history report for up to 10 years, and you may also not be approved for certain loans for a period after filing. On the other hand, most people report that the practical effect of Mesa bankruptcy is minimal after 3 or 4 years of remaining up to date on their accounts.

Will I lose everything that I own?

No, you won't. Our attorneys know exactly how to protect your property. Our clients are usually able to keep most if not all of their assets when they file bankruptcy with us.

Will my creditors stop calling me?

They will. As soon as you file a petition with the Mesa bankruptcy court, the court will stop your creditors from contacting you in any way. Our bankruptcy attorney will ensure that all the paperwork is in order, so that you can file your petition and get your creditors off your back as soon as possible.

What exactly is the Mesa bankruptcy process?

The first place to start is with a free consultation with an expert bankruptcy attorney. With your attorney, you can explore all your options and determine if Mesa bankruptcy is right for you. Your attorney will help you decide which type of Mesa bankruptcy is best for your situation and assist you in getting all the paperwork ready.

The Mesa bankruptcy court requires all debtors to complete a credit counseling class before filing for bankruptcy. You can complete this course in a classroom, over the phone, or on the internet. Your Mesa bankruptcy attorney will help you find a class that will work for you.

Once you file your petition with the bankruptcy court, the court will notify your creditors and prohibit them from attempting to collect any more money from you. This is known as an automatic stay.

Your attorney will help you write a list of your assets and debts. Your assets are listed either as exempt or non-exempt. You will keep all your exempt assets after you file bankruptcy. Your non-exempt assets can be taken from you and sold to pay your creditors if you and your attorney do not make other arrangements to pay the value of these assets in your Mesa bankruptcy. Your attorney understands the rules that determine which assets are exempt. Your Mesa bankruptcy attorney also knows how to get more, if not all, of your assets protected under exemption or payment plans.

You and your attorney will go to a meeting with a court appointed trustee and your creditors. Your list of assets and debts will be reviewed. Your non-exempt assets will be addressed. You must also complete a personal finance management course in a classroom, over the phone or on the internet. At the end of your case, the court will discharge all dischargeable debt, or forgiven, by order of the bankruptcy court. At that point you have successfully completed the Mesa bankruptcy process and can live without the burden of debt!
